We, Yin Yang Inc. (“we”, “us”, “our”, “Company”) are the owners of the website truto.one (“Website”) and the web-based application called ‘Truto’ (the “Application”), collectively referred to as the “Platform”. The Website showcases the Application and its feature. The Application allows Customers of the Company to build native integrations with other software products through APIs (“Services”).

 We respect the data privacy rights and are committed to protecting personal information collected on this Platform. This Privacy Policy (“Privacy Policy”) sets forth how we collect, use, and protect the personal information collected on this Platform.

1. “User(s)” “you”, and “your” shall mean individuals that visit/use/access the Platform;
2. “Customer” shall mean any person, company, or entity which uses, accesses, or purchases a subscription to the Platform;
3. “Personal Information” means information that can be used to identify a user, including but not limited to the user’s first name, last name, mobile number, residential address, email address, company email, company name and designation.
4. “Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Information;
5. “Processor” means a natural or legal person, public authority, agency or other body which processes Personal Information on behalf of the Controller.

We may collect your Personal Information in the following ways:

1. Personal Information collected through our Platform: You may provide Personal Information when you visit our Platform, request a demo of our Services, chat with us on our Platform and/or contact us through our Platform. You may provide your Personal Information when you contact us or write to us at our email address. You may provide information including but not limited to your name, email address, phone number, company name, and designation. The Company is the Controller of the Personal Information shared by the visitors of the Website.
2. User account: You may provide Personal Information including but not limited to your name, email address, company name, designation, username, and password when creating an account on our Platform.
3. Payment Information: You may elect to pay for the Services through our Platform, we may collect certain information such as name and email address to process your request. You will be required to provide certain payment information directly to our payment processing partners, including but not limited to your name, and credit/debit card information. We do not access, store or collect your credit/debit card information.
4. Personal Information collected for recruitment purposes: You may provide Personal Information when you apply for a job at our Company through the careers page on our Platform. You may provide us with information including but not limited to name, email address, contact information, CV/resume, educational information, and employment information.
5. Social media platforms: We may also collect, store and use your Personal Information when you access social media pages operated by us on platforms such as Facebook, YouTube, Instagram, Twitter, and/or LinkedIn.

This section concerns the Personal Information of the User collected by the Customer, and such collection may be facilitated by us.

1. The Company as a Data Processor: The Customer sets the purpose and means of processing of such Personal Information. We process such Personal Information only on behalf of and on the instructions of the Customer and for the purposes of rendering our Services to the Customer.
2. Customer Privacy Policy: If you are the User of the Platform and your Personal Information was shared with us by the Customer, the privacy policy of the Customer, on whose behalf we collect and process the Personal Information, will apply. This means that any enquiry, request, objection or complaint that you as a User may have in connection with the collection and/or processing of Personal Information that forms part of your Platform usage should be addressed to and resolved by the Customer.
3. Personal Information:Depending on the nature of services and Customer requirements the Company processes Personal Information on behalf of Customer/s. We may process Personal Information including but not limited to the name, email address, and contact number.

The Customer has complete control over the Personal Information and the Company processes the Personal Information on the Customer’s behalf.

We will process the Personal Information for as long as we provide services to the Customer and the Customer maintains active accounts of such Users.

We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. Tracking tools also used are beacons, tags and scripts to collect and track information and to improve and analyze our Platform. You may choose to disable cookies through your browser settings. User undertakes that he shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Information shared with us whether of its own or any third party. In the event the User is sharing any Personal Information on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal Information with the Company, and obtained a written consent from such third party and the Company shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Information shall be subject to the terms and conditions of this Privacy Policy.

We use the Personal Information for the following purposes:

1. to inform you about our Services and to respond to your requests;
2. for the creation or development of business intelligence or data analytics in relation to the services provided by us (for this purpose we may share the Personal Information with certain software or tools available online);

We are committed to maintaining information security and protecting customer data from potential breaches. All Personal Information is stored on cloud servers hosted by third-party service providers. We have implemented security measures such as 256-bit encryption for the protection of Personal Information. Although we provide appropriate firewalls and protections, we cannot warrant the security of Personal Information transmitted as these systems are not hackproof. Data pilferage due to unauthorized hacking, virus attacks, and technical issues is possible, and we will take necessary measures to mitigate such events.

You have the right to access Personal Information in our possession, the right to have us rectify or modify any such Personal Information, the right to have us erase/delete your Personal Information, the right to restrict us from processing such Personal Information, right to object to our use of Personal Information, withdraw consent at any time where we are relying on consent to process Personal Information. Depending on the nature of the request, we may ask you to complete a Personal Information request form or seek certain details to verify the request. Residents of the European Union (“EU”) and United Kingdom (“UK”) should note that this Privacy Policy has been updated in accordance with the requirements of the EU General Data Protection Regulation (the “GDPR”) and the UK GDPR, the United Kingdom Data Protection Act 2018, the Privacy and Electronic Communications Regulations, and any regulation superseding any of the foregoing (“UK Privacy Laws”). As per the provisions of the GDPR and UK Privacy Laws we shall be considered the Controllers of the Personal information collected as a result of your use/access of the Platform and Processors of the Personal information collected as a result of your use/access of the Services.

This Privacy Policy shall in all respects be governed by and construed and enforced in accordance with the laws of the state of Oregon, USA and the competent courts in the state of Oregon, USA shall have an exclusive jurisdiction to adjudicate any subject matter under this Privacy Policy.
